Welcome to Tupakase! These Terms and Conditions ("Terms") govern your use of the Tupakase mobile application (the "Service") provided by the developer of Tupakase ("I," "me," or "my"). By accessing or using my Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Introduction

Tupakase is a mobile application I developed as a side project to connect users with service providers in Uganda. My goal is to provide a platform that facilitates the discovery and engagement of services.

2. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify me immediately of any unauthorized use of your account.

3. Services

Tupakase provides a platform for users to find and book services from various providers. While I strive to ensure a good experience, I do not vet, endorse, or guarantee the quality, safety, or legality of the services provided by third-party service providers. Any transaction or interaction between you and a service provider is solely between you and them. I am not a party to such interactions and any disputes must be resolved directly between you and the service provider.

4. User Content

You may be able to submit content, such as reviews and ratings, to the Service. You retain ownership of your content, but you grant me a worldwide, royalty-free, perpetual, and transferable license to use, reproduce, and display your content in connection with the Service. You are solely responsible for the content you post.

I strive to provide a reliable and useful Service, but it is offered on an "as is" and "as available" basis. This means I cannot guarantee that the Service will always be uninterrupted, secure, or completely free of errors. While I make reasonable efforts to ensure the accuracy of information on the platform, I do not warrant the completeness or correctness of any information, including service provider listings. Your use of the Service is at your own discretion and risk.

7. Limitation of Liability

To the fullest extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. As Tupakase is a platform connecting you with third-party service providers, my liability is limited to issues directly related to the functioning of the application itself. I am not responsible for the actions, services, or conduct of any third-party service provider you connect with through the app.

8. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the Republic of Uganda, including but not limited to the Electronic Transactions Act 2011 and the Data Protection and Privacy Act 2019.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, Cap. 4 of the Laws of Uganda. The seat of arbitration shall be Kampala, Uganda.

9. Indemnification

You agree to indemnify and hold me harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Changes to Terms

I reserve the right to modify these Terms at any time. I will do my best to notify you of any changes, for example by posting the new Terms within the app. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
